Unemployment benefit in Poland for foreigners: who qualifies and how to register

Registering at a Polish labour office

"I'm a foreigner, I'm not entitled to anything," says Andriy, who was laid off with his whole shift after two years at a factory. It's probably the most common belief among Ukrainians and Belarusians who lose their jobs in Poland. And the most expensive one: because of it, people live on savings for months when they could be getting a benefit and health insurance.

A foreigner who worked legally and paid contributions can register as unemployed on the same terms as a Polish citizen. But there are a few details that, in practice, lead to refusals — more on them below.

Who can register

  • Legal stay with access to the labour market. Karta pobytu, karta stałego pobytu, EU long-term resident status, or UKR status for Ukrainian citizens.
  • Ready to work. You're not working, not in full-time study, and can start a job if one is offered.
  • Place of residence. You register at the county labour office (powiatowy urząd pracy) where you live or stay. Zameldowanie usually isn't required, but the address must be real.

Unemployed status gives you NFZ health insurance even if there's no cash benefit. That alone is often worth registering for.

Who gets money: the 365-day rule

Registration alone doesn't mean a benefit. Zasiłek dla bezrobotnych is due if, in the 18 months before registering, for a total of at least 365 days you:

  • Worked on an employment contract or umowa zlecenie, and
  • Earned at least the minimum wage with Labour Fund contributions paid.

This is the most common reason for refusal: on zlecenie with few hours, monthly income is often below the minimum wage, and those months don't count. Work in Ukraine or another non-EU country doesn't count towards the 365 days either.

How much and for how long

The benefit amount is indexed every year on 1 June, and your urząd pracy will tell you the exact figure. It depends on your total work history: lower with under 5 years, higher with over 20. The standard period is 180 days, longer for some groups (e.g. people over 50 with a long work history, or parents of children under 15).

If you quit yourself or left by mutual agreement on your own initiative, the benefit only starts 90 days after registration. If you were let go for the employer's reasons, there's no delay.

How to register, step by step

  1. Documents. Passport or residence card, PESEL, świadectwa pracy for the last 18 months, diploma or school certificate (translated, if you have one).
  2. Online application. Via praca.gov.pl with a profil zaufany, or in person at the office.
  3. Meeting with an adviser. A date is set after you apply; your profile and support plan are drawn up there.
  4. Decision. The office issues a decision on unemployed status and a separate one on the benefit.

Register as soon as possible after losing your job. The benefit counts from the date of registration, not the day you lost the job — missed weeks won't be paid back.

Besides the benefit, the urząd pracy can send you on free courses and qualifications — for example, forklift training with a UDT exam — or on a paid internship. For a foreigner this is often a faster route to a better job than the benefit itself.

Obligations that cost you the status

  • Appointments. Missing a set appointment without good reason means losing your status.
  • Offers. Refusing suitable work, an internship or training without reason also removes your status.
  • Side jobs. Any paid work, even for a few days, must be reported. Unreported work means repaying the benefit.
  • Travel. Going abroad must be reported; a long absence ends your status.

Residence card and unemployment

If your karta pobytu was issued for work with a specific employer, registering as unemployed doesn't extend its basis. After losing your job you must notify the voivode and look for a new employer. Check your situation at the urząd wojewódzki — the rules differ between card types.

Checklist after losing your job

  • Świadectwo pracy. Collect it on your last working day.
  • 365 days. Count the months in the last 18 with income at least at minimum wage.
  • Registration. Apply on praca.gov.pl in the first days.
  • Voivode. If your residence card is tied to work, notify within 15 working days.
  • Insurance. Check you've been registered with NFZ as unemployed.
  • Calendar. Note your appointment dates — missing one costs you the status.
